The downstream market for liquid fuels is open and liberal. However, an Expert Group constituted by members of the Ministry of Fuel and Energy and fuel traders, publishes a non-mandatory indicative price for fuels every ten days. Retailers usually obey to that indicative price, because the Ukrainean antimonopolistic committee considers higher prices as an abuse of a monopolistic status and might therefore impose penalties.
Imported fuels are duty-free. This fact induces high pressure on the national oil refineries, as they can not compete with foreign refineries in terms of efficiency. Thus, imported fuels are more inexpensive at most times. There are also Russian oil companies digging oil in Russia, that also are retailers in the Ukraine. However, the advantage of having no wholesale margins is balanced out by immense transportation costs.
By law, crude oil digged in the Ukraine has to be sold at an official auction. However, there are cases where this law is de-facto disobeyed through interwoven oil and refinery companies, leading to the exclusion of competitors from the market.

Excise duty rised in early 2011: From 132€ to 182€ per ton for petrol, and from 30€-75€ to 42€-90€ for diesel, depending on the the sulfur share. According to an internet Article (see App. A1), this excise tax increase was de-facto reversed again in April 2011.
